Please read these Terms of Use carefully, as they apply to your use of the Parent/Guardian Connection Tool (the “Tool”). Please note that your use of the Tool through Smartsheet is also subject to the Smartsheet Privacy Notice and User Agreement.

Acceptance and Modification of Terms

Use of the Tool is conditioned on your acceptance, without modification, of these Terms of Use. By using this Site you represent that you have read and understand the terms and conditions and that you agree to be bound by these Terms.

We may modify these Terms from time to time at our sole discretion. When a modification is made, we will post a revised version of these Terms on this page. Modifications will be effective when they are posted. You should review these Terms from time to time. Each time you log on to the Site, you are agreeing to have accepted any such modifications.

Use of the Tool

For as long as you comply with these Terms, we grant you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use the Tool for lawful intended purposes permitted by these Terms. In communicating with connections made through the tool, you agree you will not post or transmit any information or material which:

• violates or infringes in any way upon the rights of others;
• is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights;
• is vulgar, obscene, profane or otherwise objectionable;
• encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law; or
• markets a childcare company or organization.

You may not use a false email address or give any form of misleading information as to the content’s origin. We reserve the right to cause the removal of any such content. We are neither responsible nor liable for any content posted by you or a third party.

You may opt out of the Tool at any time by completing this opt-out request. We will process these removal requests promptly. Bear in mind that opting out of the Tool will not prevent individuals to whom you have provided your information from contacting you; you may wish to inform your contacts established through the tool that you do not wish to receive further communications.

Use of Your Information

By using the Tool, you consent to the sharing of your name, UVA email address, child(ren)’s age range(s), elementary school district, connection priorities, and whether you are a newcomer with other, similarly situated UVA employees. This information will be available in the Connection Tool to UVA employees who:

• Have also opted into the Connection Tool,
• Live in the same high school district as you,* and
• Have a child in the same age range as (one of) yours.

**Note: Residents of surrounding counties will view a slightly larger geographic area, to ensure more opportunities for connection. These geographic areas will be grouped:

Rockingham, Augusta, Nelson

Greene, Madison, Culpeper, Orange

Louisa, Fluvanna, Buckingham

Your information will only be available to the subset of individuals who have registered in the Tool and who meet all the above criteria. Registrants may include UVA Employees, including Employees of UVA, UVA Health System, and the University of Virginia Physician’s Group and UVA post-docs, graduate and professional students and medical residents and fellows.

A summary of the tool registration responses may be shared with UVA leadership (including HR, the Provost’s Office, the Deans’ Offices and the Family Support Collab that is reviewing dependent care options for UVA Employees) for purposes of identifying trends and key priorities articulated by participants. This information will be shared anonymously and will not be attributed to individuals.

Information submitted to the Tool is considered personnel information exempt from disclosure under the Virginia Freedom of Information Act.

Your Obligations and Our Responsibility; Safely Using The Tool

By using the Tool, you agree that it is your responsibility to evaluate the accuracy and usefulness of any advice, content, services or materials available through the Tool. Under no circumstance will we be liable for any loss or damage caused by your reliance on information obtained through the Tool, other than as required under applicable law.

The Tool uses the Smartsheet collaboration software as a service offering. Although we contract with and link to Smartsheet sites, we are not responsible for examining or evaluating those sites, and we do not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. Your use of such web sites is at your own risk, and you should carefully review their privacy statements and other conditions of use.

The Tool is for users who are at least 18 years of age. You agree that you will disclose your age if you are under 18 years of age before using the Tool.

Registration for the Tool is behind Netbadge, and the University cross-references users against a list of active University employees, however, the University does not conduct criminal background or further identity verification checks of its users. We make no representations or warranties as to the conduct, identity, intentions, legitimacy, or veracity of users. We reserve the right to conduct—and you authorize us to conduct—any criminal background check or other screenings at any time using available public records, and you agree that any information you provide may be used for that purpose. You are solely responsible for your interactions with other users. You should follow reputable safety tips and other sensible safety precautions. Use your best judgment and take appropriate safety precautions when communicating with or meeting new people. Although we encourage a respectful user experience, we are not responsible for the conduct of any user of the Tool, on or off the Tool, and you agree to use caution in all interactions with other users, particularly if you decide to communicate off the service or meet in person.

Limitation of Liability

You agree that the use of the Tool is at your own risk. We reserve the right to modify, update, suspend, discontinue, or restrict the use of or access to this Tool or any portion of it at any time and without notice or liability. We provide the Tool on an “as is” and “as available” basis and to the extent permitted by applicable law, grant no warranties of any kind, whether express, implied, statutory or otherwise with respect to the Tool (including all content contained therein), including, without limitation, any implied warranties of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement. We do not represent or warrant that (a) the Tool will be uninterrupted, secure, or error free, (b) any defects or errors in the Tool will be corrected, or (c) that any content or information you obtain on or through the Tool will be accurate. We make no guarantees as to the number of active users at any time or the users’ willingness to communicate with or meet you.

To the fullest extent permitted by Virginia law, in no event will the University or its employees or representatives be liable for any indirect, consequential, exemplary, incidental, special or punitive damages, including, without limitation, loss of profits, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Tool, (ii) the conduct or content of other users or third parties on, through, or following use of the Tool. Nothing in these Terms constitutes a waiver of the sovereign immunity of the University and the Commonwealth of Virginia

You agree to hold the University of Virginia and its representatives harmless from any and all losses, damages, rights, claims and actions of any kind arising from or related to the Tool, content or related services, including but not limited to: (a) telephone, electronic, hardware or software, network, Internet or computer malfunctions, failures or difficulties of any kind; (b) failed, incomplete, garbled or delayed computer transmissions; (c) any condition caused by events beyond the control of UVA that may cause the Tool to be disrupted or corrupted; (d) any injuries, losses or damages of any kind arising in connection with or as a result of your use of the Tool or related services. All content on the Tool is considered “as is” and do not carry warranties of any kind.
